Fresenius Medical Care Canada: Severance Packages

Fresenius Medical Care Canada is the Canadian arm of Fresenius Medical Care AG & Co. KGaA (Fresenius Medical Care), which is a German multinational health care company. The organization produces a variety of kidney dialysis products, including dialysis machines, dialyzers, and related disposables.

Founded in 1996, Fresenius Medical Care employs a global workforce of more than 36,000 people, according to LinkedIn. Headquartered in Bad Homburg v.d. Höhe, Germany, the company has Canadian offices in Ontario and British Columbia.

Fresenius Medical Care claims on its website that its global network consists of more than 4,100 dialysis clinics.

Recent layoffs at Fresenius Medical Care

  • December 2022: Samfiru Tumarkin LLP has been contacted by several employees at Fresenius Medical Care Canada who claim that the company is laying off a significant number of workers across Ontario. Our employment lawyers are following up with affected staff to better understand the situation.
  • November 2021: Fresenius Medical Care announced that it’s planning to cut approximately 5,000 full-time jobs. The company said patient deaths from the COVID-19 pandemic has reduced revenue prospects. It remains unclear how many Canadian employees could be affected by the latest reduction.
  • April 2021: Fresenius Medical Care is laying off 121 employees in Austin, Texas. In late February, the company announced a plan to cut costs globally and streamline its operating model. It remains unclear if the cuts are related to the restructuring.

Severance for Fresenius Medical Care Canada employees

In Canada, non-unionized employees at Fresenius Medical Care may get up to 24 months of severance pay when they are fired or laid off from their job. This applies to individuals working in any capacity—full-time, part-time, or hourly—in Ontario, Alberta, and British Columbia. Contractors may also be entitled to severance pay due to employee misclassification.

Severance is the compensation provided to non-unionized workers in Canada by their employer when they are terminated without cause.

Even if an employee is fired for cause, they may still be eligible for full severance pay. This is due to the high standards required to legally justify for-cause dismissal.
