1. What does a Vancouver employment lawyer do?
A Vancouver employment lawyer helps non-unionized employees with severance pay, wrongful dismissal, workplace harassment, and employment contracts. They ensure employees receive fair treatment and full compensation under British Columbia and law or the Canada Labour Code.
2. How much severance pay am I entitled to in Vancouver?
Most non-unionized employees in Vancouver are entitled to much more severance pay than what their employer initially offers. Severance is based on factors like your age, position, length of service, and your ability to find similar work.
You could be owed up to 24 months’ pay, even if your employer only offers you the minimum required under B.C.’s Employment Standards Act (ESA).

3. Can my employer fire me without cause in Vancouver?
Yes – but they still have to provide you with full severance pay. Employers can let you go without cause as long as they meet their legal obligations, which include proper severance. If you don’t receive enough pay, it becomes a wrongful dismissal.
If you’ve been fired without cause, don’t sign anything before speaking with a Vancouver employment lawyer. You could be owed significantly more than what’s being offered.
4. What should I do if I’m offered a severance package in Vancouver?
Don’t sign anything until you’ve had it reviewed by an experienced Vancouver employment lawyer. Most severance packages undervalue what employees are legally entitled to. Once you accept an offer, you can’t go back and ask for more – so it’s important to get it right the first time.

5. Can I be fired in B.C. while on a medical leave or disability?
In most cases, no. Your employer has a duty to accommodate your medical condition, which includes respecting your leave of absence. If you’ve been fired while on leave or after applying for long-term disability, that may be a human rights violation. Speak to our team right away – these cases are time-sensitive.
