Real People,
Real Results

My company claimed the amount of notice we were given negates any severance they would have to pay. Having heard radio ads for Samfiru Tumarkin, I contacted them and was put in touch with a lawyer. She let me know that the notice was nowhere near sufficient and immediately sent a letter to the company. I am forever grateful to their team.

Serving Employees Across Vancouver

Your rights as a non-unionized employee are protected, no matter where you live or work in Vancouver, the Lower Mainland, or anywhere in B.C. Our experienced Vancouver employment lawyers represent individuals in neighbourhoods throughout the city, including:

Frequently Asked Questions about Employment Law in Vancouver

1. What does a Vancouver employment lawyer do?

A Vancouver employment lawyer helps non-unionized employees with severance pay, wrongful dismissal, workplace harassment, and employment contracts. They ensure employees receive fair treatment and full compensation under British Columbia and law or the Canada Labour Code.

2. How much severance pay am I entitled to in Vancouver?

Most non-unionized employees in Vancouver are entitled to much more severance pay than what their employer initially offers. Severance is based on factors like your age, position, length of service, and your ability to find similar work.

You could be owed up to 24 months’ pay, even if your employer only offers you the minimum required under B.C.’s Employment Standards Act (ESA).

3. Can my employer fire me without cause in Vancouver?

Yes – but they still have to provide you with full severance pay. Employers can let you go without cause as long as they meet their legal obligations, which include proper severance. If you don’t receive enough pay, it becomes a wrongful dismissal.

If you’ve been fired without cause, don’t sign anything before speaking with a Vancouver employment lawyer. You could be owed significantly more than what’s being offered.

4. What should I do if I’m offered a severance package in Vancouver?

Don’t sign anything until you’ve had it reviewed by an experienced Vancouver employment lawyer. Most severance packages undervalue what employees are legally entitled to. Once you accept an offer, you can’t go back and ask for more – so it’s important to get it right the first time.

⚠️ Don’t Sign That Offer! Get legal advice before you sign anything, even if they deadline. Read more about why those deadlines aren’t legally binding and asking for an extension.

5. Can I be fired in B.C. while on a medical leave or disability?

In most cases, no. Your employer has a duty to accommodate your medical condition, which includes respecting your leave of absence. If you’ve been fired while on leave or after applying for long-term disability, that may be a human rights violation. Speak to our team right away – these cases are time-sensitive.

6. How much does it cost to hire an employment lawyer in Vancouver?

At Samfiru Tumarkin LLP, we offer a No Win, No Fee option for many employment law cases (where applicable). That means you won’t pay anything upfront, and legal fees only apply if we successfully resolve your case. We also provide a confidential, no-obligation consultation, so you can understand your rights before deciding how to proceed.

In many cases, we’re able to negotiate for your employer to cover part or even all of your legal fees.

7. Do I need a lawyer if I file a complaint with the Employment Standards Branch?

No! If you file a claim with the Employment Standards Branch, you limit your severance pay to only the minimum entitlements under the ESA. Many people don’t realize this means they could lose out on tens of thousands of dollars in additional compensation.

You may be entitled to much more through a severance package negotiated by an experienced Vancouver employment lawyer. That’s why it’s important to speak with our team first, before you make a decision that could affect your legal rights.
