What should I do if my claim is denied?
Do not appeal directly to the insurance company. Their appeals process is designed to run out your clock. Contact a long-term disability lawyer immediately to review your denial letter and file a legal claim to force them to pay.
Can I sue the insurance company?
Yes. If your insurance provider has breached their contract by unfairly denying or cutting off your benefits, you have the right to file a legal claim against them for the compensation you are owed.
What does “change in definition” mean?
Typically, after two years on LTD, the definition of disability changes from “unable to do your own occupation” to “unable to do any occupation.” Insurance companies often use this milestone to cut people off, even if they still cannot work.
What if the insurer says I’m not totally disabled?
You do not need to be bedridden to be considered “totally disabled.” If your condition prevents you from performing the essential duties of your job, you likely qualify. We routinely challenge and defeat insurance company doctors.
