How Our Toronto Employment Lawyers Can Help

  • Wrongful Dismissal

You're owed compensation if you lose your job without proper severance pay in Ontario. Our Toronto wrongful dismissal lawyers will explain your rights.

  • Constructive Dismissal

If your employer has changed your job in a serious way without your consent, you may be able to treat it as a termination and pursue severance.
  • Disability Claims

If you’ve been cut off or denied long-term disability benefits or are being pressured to return to work, our team can help protect your disability rights and income.
  • Employment Contract Review

Before you sign a new job offer or exit package, we can review your contract to ensure your rights and compensation are fully protected.
  • Human Rights & Discrimination

We represent employees who are facing discrimination, harassment, or a toxic work environment. Ontario law protects your right to fair treatment at work.

I was constructively dismissed from my employer of 9 years. I spoke with David Vaughan who connected with me on a human level. The result ended with a better than expected settlement. If it wasn't for Dave, I would have continued to believe that the employer is always right!

I was assisted by Chantel Goldsmith in getting a fair settlement from my former employer after being terminated without cause after 11 years of employment in North York. She and her assistant Cassandra were very helpful and I highly recommend Chantel to anyone seeking legal assistance!

I was wrongfully terminated after 4 years on the job. After trying their Severance Pay Calculator and watching a few episodes of the Employment Law Show, I reached out to Samfiru Tumarkin LLP and I'm glad I did. They settled my case out of court and got me a very fair settlement in what I consider to be a very short amount of time.

I contacted Sivan Tumarkin because my insurance company denied benefits to my paraplegic son. Prior to contacting Sivan, I had reached out to several other law firms. I was thrilled when he took on our case. The entire team went above and beyond to fight the insurance company.

Serving Employees Across Toronto

Your rights as a non-unionized employee are protected, no matter where you live or work in Toronto, the GTA, or anywhere in Ontario. Our experienced Toronto employment lawyers represent individuals in neighbourhoods throughout the city, including:

Frequently Asked Questions about Employment Law in Toronto

1. What does a Toronto employment lawyer do?

A Toronto employment lawyer helps non-unionized employees with severance pay, wrongful dismissal, workplace harassment, and employment contracts. They ensure employees receive fair treatment and full compensation under Ontario law.

2. How much severance pay am I entitled to in Toronto?

Most non-unionized employees in Toronto are entitled to much more severance pay than what their employer initially offers. Severance is based on factors like your age, position, length of service, and your ability to find similar work.

You could be owed up to 24 months’ pay, even if your employer only offers you the minimum required under the Ontario Employment Standards Act (ESA).

3. Can my employer fire me without cause in Toronto?

Yes – but they still have to provide you with full severance pay. Employers can let you go without cause as long as they meet their legal obligations, which include proper severance. If you don’t receive enough pay, it becomes a wrongful dismissal.

If you’ve been fired without cause, don’t sign anything before speaking with a Toronto employment lawyer. You could be owed significantly more than what’s being offered.

4. What should I do if I’m offered a severance package in Toronto?

Don’t sign anything until you’ve had it reviewed by an experienced Toronto employment lawyer. Most severance packages undervalue what employees are legally entitled to. Once you accept an offer, you can’t go back and ask for more – so it’s important to get it right the first time.

⚠️ Don’t Sign That Offer! Get legal advice before you sign anything, even if they deadline. Read more about why those deadlines aren’t legally binding and asking for an extension.

5. Can I be fired in Ontario while on a medical leave or disability?

In most cases, no. Your employer has a duty to accommodate your medical condition, which includes respecting your leave of absence. If you’ve been fired while on leave or after applying for long-term disability, that may be a human rights violation. Speak to our team right away – these cases are time-sensitive.

6. How much does it cost to hire an employment lawyer in Toronto?

At Samfiru Tumarkin LLP, we offer a No Win, No Fee option for many employment law cases (where applicable). That means you won’t pay anything upfront, and legal fees only apply if we successfully resolve your case. We also provide a confidential, no-obligation consultation, so you can understand your rights before deciding how to proceed.

In many cases, we’re able to negotiate for your employer to cover part or even all of your legal fees.

7. Do I need a lawyer if I file a complaint with the Ministry of Labour?

No! If you file a claim with the Ontario Ministry of Labour, you limit your severance pay to only the minimum entitlements under the ESA. Many people don’t realize this means they could lose out on tens of thousands of dollars in additional compensation.

You may be entitled to much more through a severance package negotiated by an experienced Toronto employment lawyer. That’s why it’s important to speak with our team first, before you make a decision that could affect your legal rights.

🛡️We Take Action: Samfiru Tumarkin LLP has held the Ministry of Labour accountable for providing misleading advice about severance pay. Learn more about the case here.
