- Chris discusses terminations for cause: An older employee who had been employed for many years was terminated for cause as a result of off-duty conduct and an arrest. It is important to note that employers have to conduct a proper investigation in order to accurately prove termination for cause.
- An employer’s actions that can constitute a termination: In some situations, the actions or failure to properly follow ESA standards can lead to a termination despite the fact that an employer has not formally fired an employee; i.e. being placed on a temporary layoff, failing to rectify workplace harassment, changing the fundamental terms of employment.
- Asked to sign a new employment contract: Employment contracts typically contain terminology that protects the rights of the employer, such as a termination clause, or the ability to change the terms of an employee’s job unilaterally.
