Summary

Canadian Employment Lawyer Lior Samfiru, Partner at Samfiru Tumarkin LLP, reveals your workplace rights in Ontario, and shatters myths and misconceptions about severance pay, terminations, workplace harassment, overtime pay, wrongful dismissal, constructive dismissal, duty to accommodate, and more.

What We Covered

THE WEEK THAT WAS #1 – I failed a big presentation for a client. My boss told me to hand in my letter of resignation the next day, which I did. Can I do anything about it now? Lior explains why, when you’re forced to resign, you can still receive severance pay.

THE WEEK THAT WAS #2 – When I started a new sales job, I discovered that I was being given a smaller sales territory than promised. I was hired under false pretences. What can I do? Is this constructive dismissal? Lior explains what an employee can do when they are the victim of misrepresentation.

CALLER: My wife just received a severance package after 20 years. She was a 60-year-old executive administrative assistant. She was offered 15 months of severance pay. Was that enough compensation for an executive assistant?

CALLER: My husband suffers a diagnosed mental illness. It impacted his work performance, and he was eventually fired and given severance. Did his employer do the right thing?

CALLER: My friend was collecting WSIB when he took some shifts at a different workplace. WSIB and his employer discovered this, WSIB cut him off and his employer fired him. Can they do that?

CALLER: I was promised benefits after 3 months of employment, but my employer has failed to follow through on that promise in my contract. What are my rights?

CALLER: I’m 73, and have just been fired. They gave me two weeks’ notice. Is that a legal amount?

CALLER: Despite a strong medical report, I was cut off long-term disability by my insurance company. Then my employer forced me to return to work or risk being fired. Do I have any recourse?

MAIN TOPIC: Sorry, You’re Not an Independent Contractor!

MAIN TOPIC: What is an Independent Contractor? How do you define that role?

MAIN TOPIC: If you don’t meet the criteria for Independent Contractor, can you still be called one?

CALLER: How do we stop an Independent Contractor from slowly becoming an Employee?

CALLER: I’m a contract professor at an Ontario college. Bill 148 was supposed to raise our pay substantially, but it hasn’t happened yet. Can Doug Ford and the Ontario PC’s repeal Bill 148 and stop the pay increase?
