- Severance for long-service senior employees: Severance pay is based primarily on the age of an employee, their position and years of service. Long-service employees can be owed up to 24 months’ pay in severance entitlements. Before agreeing to an initial offer, employees should seek advice from an employment lawyer.
- A completely voluntary resignation: Due to a toxic workplace, or as a result of changes made to their job, some employees resign from their employment. Employees that leave their jobs as a result of the actions of their employer have been constructively dismissed.
- Updates while on medical leave: Employees that are on medical leave do have an obligation to update their employer with a prognosis. Employers are not entitled to know the specifics of an employee’s medical condition. Employers are also not permitted to penalize or terminate an employee due to an illness or condition.
