- Let go after months of employment: In many cases, short-service employees are owed comparatively more severance pay than longer-service employees. The new employer could owe employees that have been induced or recruited from another job additional severance pay. Enhanced severance pay will consider the previous years of service of an employee.
- Company relocation impacts employee commute: Employers do not have the ability to impose major changes to the terms of employment without an employee’s consent. A major change can be considered a relocation which adds significant time to an employee’ commute. Employees do not have to accept a proposed change proposed by their employer. In the event a change is still imposed, employees can consider their employment as constructively dismissed.
- Taking a medical leave from work: Employees are permitted to take as much time away from work due to a medical leave with the support of a treating doctor. Employers cannot terminate an employee for taking medical leave or as a result of an illness or injury.
- The termination clause in an employment contract: In some employment contracts, employers will include a termination clause in order to limit the future severance entitlements of an employee. Employees should seek legal advice before signing an employment contract in order to protect their rights and entitlements.
