- An employee let go with positive performance: Many employees mistakenly believe that due to a lack of negative criticism and errors they cannot be terminated by their employer. Employers are permitted to terminate employees for any reason as long as adequate severance pay is offered.
- Employees’ job duties have changed: Employers cannot decide to implement major changes to the terms of employment without an employee’s consent; it is considered constructive dismissal. Employees can choose to accept these changes however if they do so, they have given their employer permission to enact changes in the future.
- Signing termination papers offered by the employer immediately: Employers that provide a fair offer will typically not pressure an employee to sign the severance package immediately or within an unreasonable amount of time. Severance pay deadlines are a pressure tactic and employees do not have to abide by these deadlines. Employees have up to two years after the initial date of termination to pursue their severance entitlements and should seek legal advice from an employment lawyer.
