- Harassed by a coworker and penalized for voicing a complaint: Employers are obligated to provide a safe working environment free from abuse and harassment. Employers who penalize or terminate employees as a result of workplace harassment are in violation of an employee’s human rights and could face additional damages. A reprisal is considered illegal and employers must instead, conduct an adequate workplace investigation and resolve all complaints.
- Definition of a wrongful dismissal: A wrongful dismissal is largely concerned with severance pay and not the reason for termination. Employers can terminate employees for any reason as long as adequate severance pay is offered to terminated employees.
- Steps after losing employment: It is typically a very stressful and difficult time for individuals in the event of termination. Employers will pressure employees to sign an initial severance offer by a deadline. It is important for employees to think rationally and seek out legal advice before signing or accepting an offer.
