Show Notes
- Rescinded job offer by an employer: Employees that have accepted a job offer and rely on the acceptance cannot have that job taken away without compensation from the prospective employer. The prospective employer will have to offer possibly several months of pay to the employee even if they never worked a day in a new position.
- LEARN MORE: Severance Pay in Ontario
- Let go as a result of a medical condition: Employees cannot be terminated or penalized as a result of a medical condition or taking medical leave. Penalizing or letting an employee go as a result of a medical condition is considered a human rights violation. Employers must accommodate an employee and should be wary that they might face additional damages if violating an employee’s human rights.
- Harassed by other employees in the workplace lead to resignation: Employers are obligated to provide a healthy and safe work environment for all staff from harassment and abuse. Complaints of harassment must be properly investigated and resolved. Failure to investigate and resolve complaints can lead to further consequences for an employer. Employees who have taken appropriate steps and have resigned as a result of a toxic workplace could actually be considered to have been terminated.
