The claimant forced into a return-to-work program

I have asthma after an accident years ago. I’m a mechanical engineer but was told to stop working. I’ve been approved for LTD but my insurer is pushing me to try to return to work. My respirologist and doctor say I’m not ready to return. What do I do?

• Returning to work: Sivan explains only a claimant’s doctor can determine whether or not they are ready to return to work, despite what the insurance adjuster says. It is important for claimants to follow the medical advice of their doctor and not return to work before they are able to. It is important to contact a disability lawyer as soon as possible when benefits are denied or cut off.

Disability benefits were cut off due to a lack of medical records

I’ve been receiving benefits for 4 years due to severe depression, and I see a psychotherapist regularly. My therapist responds to the insurance company, but my doctor takes a long time to provide records. My insurer has informed me that they don’t have his records and my benefits will be cut off if they don’t have an update.

• Updated medical information: Insurance companies are entitled to medical updates under most insurance policies. Claimants that have been on disability benefits for over two years are considered unable to do any occupation. If a claimant does not have the necessary information from their care provider, they could benefit from seeking a new doctor.
