- Labelled as an independent contractor: Many individuals are mistakenly classified as independent contractors when they are employees. Misclassified employees can miss out on vital employment rights, particularly severance pay upon termination. Employment laws dictate whether or not an individual is an employee and not an employer.
- Terminations without cause: Terminations without cause are the most common type of termination. Without “cause” terminations occur for many reasons, such as restructuring, dissatisfaction, etc. Employers can terminate employees for any reason as long as adequate severance pay is paid
- Establishing a “for cause” termination: Many employers wrongfully dismiss employees due to stating a “for cause” termination. It is very difficult to establish an accurate termination for cause as they should only occur due to serious misconduct by an employee. Simple errors and mistakes cannot typically justify a termination for cause.
