Show Notes

  • Change to payment structure: Employers are not within their rights to implement major changes to an employee’s position. This can include a reduction of hours, pay, demotion, etc. Employees should be wary of accepting an initial change as it permits their employers from implementing future changes. Employees can choose not to accept a change and instead consider constructive dismissal.
  • Investigating harassment complaints: Employers have a legal obligation to provide a safe environment for all staff, free from harassment. Employers, in both small and large corporations, must investigate all complaints regarding bullying and harassment. Investigations must be unbiased which can mean hiring an external investigator. Complaints that are not resolved can lead to many statute violations.
  • Terminating an employee “for cause”: Many employers incorrectly terminate an employee for cause despite a lack of disciplinary measures. Employers must be able to prove there have been disciplinary measures taken in the past, and there are no alternative solutions other than termination. An accurate termination for cause cannot be due to simple mistakes and errors made by an employee.
