Show Notes

  • Medical accommodation requests: Employees should provide a doctor’s note to their employer listing their restrictions and limitations. Employers cannot refuse to accommodate an employee’s medical condition without an initial attempt to provide what is needed. An outright refusal to accommodate can be considered a human rights violation. Employees should speak to an employment lawyer to determine their next steps.
  • Signing an NDA upon termination: It is very common practice for employers to ask employees to sign an NDA in exchange for a severance package. Employers are typically asking employees not to disclose the amount of money they received as well as possibly other topics. There are different considerations in regard to allegations of harassment and disclosing information.
  • Annual bonus payments: A bonus cannot be considered discretionary if it is provided consistently every year. Employees can look at the terms of their employment contract to determine if there are stipulations regarding their bonus payments. It is important to note that if an employee has received a bonus for many years, it can become a term of employment.
