Show Notes
- Government minimum standards of severance: Many employers and employees mistakenly believe they are only owed their minimum severance entitlements. The Ministry of Labour cannot provide advice for employees hoping to determine their full common-law severance entitlements. It is important to seek legal advice after termination in order to determine the adequacy of a severance package.
- Returning to work from long-term disability: Employees that have received clearance from their treating doctor to return to work must be allowed to do so by their employer. Employers must also accommodate any medical needs or restrictions of employees. A failure to accommodate can be considered a human rights violation.
- Suspended due to vaccination status: Employers are not permitted to place employees on suspension or terminate an employee for cause due to their vaccination status. Employers are permitted to terminate employees for any reason as long as adequate severance pay is offered.
