- Employee harassed by a coworker: Employees that are facing bullying and harassment at the workplace should document each incident in writing. Employers are obligated to investigate all complaints of harassment that have been brought forth. Employees cannot be penalized or terminated due to filing harassment complaints.
- An employee is required to work unpaid time by an employer: Employers have to pay employees for the time spent working. Employees that are being required to work without compensation can file an unpaid wages complaint with the Ministry of Labour. Employees cannot be terminated as a result of filing a complaint.
- Employee obligations after termination: Employees are obligated to find employment once they have been terminated. The duty to mitigate should not be a significant factor in an employer’s severance package. In order to prevent employees from delaying future employment, employers can negotiate settlements.
