Show Notes
- Fired after medical leave and injury: Employers cannot terminate employees due to an illness or injury. Employers could potentially be violating an employee’s human rights and Occupational Health and Safety violations. Employees in this situation would not only be owed severance pay but additional damages from their employer.
- Fired for an unreasonable issue: Employers are within their rights to terminate employees for any reason as long as it is not discriminatory. A wrongful dismissal occurs if an employee has been let go and not offered adequate severance pay. Upon termination, an employee should seek legal advice to determine whether or not the severance offered was appropriate.
- Accommodating child and family care obligations: Employers have a duty to accommodate an employee’s family and childcare obligations based on family status. Employers that fail to do so could be in violation of their employee’s human rights.
