- Returning to work from medical leave: Employees are permitted to take as much time as necessary in order to recover as long as their doctor supports their inability to work. Often, when employees are cut off from disability benefits, employers incorrectly assume they are ready to return to work. Claimants and employees should listen primarily to the advice of their doctor regarding a return to work.
- Employer building a case against an employee: In order to create a file against an employee, repeated warnings and criticisms are documented by the employer. It is very difficult for employers to terminate an employee for cause without proof that disciplinary action was taken and no other options are available. Employees who feel the reprimands or negative performance reviews are inaccurate should disagree in writing.
- Given a new employment contract: Employees should seek legal advice before signing an employment contract. Employment contracts typically seek to limit the rights of an employee and protect the best interests of the employer.
