- Chris discusses the manner in which an employer terminates an employee: It is considered rare when punitive damages are awarded but are most commonly implemented if an employer has behaved in a malicious or harmful manner towards their employees. Employers cannot withhold compensation from their employees upon termination.
- Key things to look out for in an employment contract: Employees should always seek legal advice before agreeing to sign an employment contract. Employment agreements often contain terminology that aims to limit the rights of employees and protect the interests of the employer, such as imposing temporary layoffs or allowing employers to change an employee’s position at their discretion.
- Employer removes an annual bonus payment for employees: Employees do not have to accept major changes to the terms of their employment such as a reduction in compensation. Bonuses can be considered a regular component of compensation and wages and so a reduction or removal can lead to constructive dismissal.
