- Small company closing down and employees let go: Employees are owed severance pay in the event that a business shuts down. While employers are within their rights to provide working notice, in many cases, additional severance pay will be owed after the notice period ends. The size of the company ultimately does not matter in determining severance.
- Significant changes made to a job: Employers are not able to implement major changes to the terms of an employee’s job, such as a dramatic pay cut, without an employee’s consent. A major change can be treated as a constructive dismissal and employees are able to pursue their severance entitlements.
- Returning from maternity leave to remote work model: Employees returning from parental or maternity leave are owed the same position that they had prior to take leave. Employers cannot penalize employees as a result of taking leave, it is considered a human rights violation. Employers who are unable to provide the position if it no longer exists must offer a comparable job.
