- Outstanding vacation pay for employees: Employees that are paid in salary as well as commission, vacation pay must also be paid for commission. It is vital for employees facing termination to speak to an employment lawyer to determine all aspects of compensation are included in a severance package.
- Refused paid lunches and breaks: Employers are required to give unpaid breaks to employees and it is considered a breach of the Employment Standards Act to refuse employees breaks.
- Overtime hours and pay to employees: Employees that are expected to work extra hours must be paid at an overtime rate of pay if they work over 44 hours a week. Employers cannot refuse to pay overtime to employees and employees are within their rights to file a complaint to the Ministry of Labour if they have not been compensated.
