- Returning to work from disability leave: Employers are obligated to take employees back from a disability or sick leave to the same position they had before they left. Employers that terminate an employee returning from leave or change the terms of their job upon a return could face a wrongful dismissal or possibly human rights damages.
- Reviewing a severance offer by a recently terminated employee: There are many different components of compensation that need to be taken into account when determining the adequate amount of severance, such as commission, bonuses, etc. In some cases, the manner and context of termination can also be important for employees and determining if any rights have been violated.
- Agency changing compensation rules and withholding pay: Employers cannot decide to withhold pay from employees and hours worked must be compensated. Employees who feel that they have not been adequately paid can file a complaint with the Ministry of Labour.
