- Elements that factor into severance pay: The basic factors for determining a severance package are typically the age of an employee, the length of service as well as the position. Employees that are recruited from a company into a new position however are in an interesting position. For employees who have been recruited and let go by the new employer, the years of service in a previous employer might be considered towards the length of service.
- Terminated as a result of vaccination status: In many cases, there is an argument to be made that if an employee is not terminated “for cause” they should be paid severance pay. In certain fields of work, there were government-mandated vaccine policies. In order to determine the next steps, employees should speak to an employment lawyer to consider available options.
- Workplace harassment and legal advice: Many employees that are in a toxic work environment are fearful of voicing complaints of harassment. In order for an employment lawyer to be able to take legal action, however, employees have to take steps in order to protect their rights. Employees should voice complaints of harassment and ensure all incidents are documented.
- Changes made to your job without consent: Employees should voice concerns as soon as a change has been implemented by their employer. The more time passes, the more difficult it becomes for an employee to pursue constructive dismissal as the change is considered to have been accepted.
