What We Covered
Will your long term disability benefits end after two years?
There are many on LTD that are under the impression that their benefits end after two years. Generally, if you are on LTD, most insurance policies should take you to age 65 if you satisfy the eligibility criteria.
Is the information in an insurance policy easy to find?
Your insurance policy should clearly state how long an employee can remain on disability benefits.
Week That Was
When working with insurance companies and disability lawyers, it is incredibly important that you are honest. This information was not disclosed and now had to be worked on during mediation.

I’ve been on LTD for 2 years due to bipolar anxiety and PTSD. My doctor and psychiatrist say I should not return to work, I’m 36 years old. My insurance company is saying I’m ready to go back, What do I do?
Mental health disability claims can be difficult to prove. Contacting a disability lawyer in this situation would be vital as it can be very quickly assessed whether or not there is a claim.
My wife is 29 years old and has had depression for years. She was on short term disability and she recently applied for LTD but was denied. The insurer says she doesn’t qualify as her anxiety and depression are work-related. What can she do?
It is common for insurance companies to take the position that the disability is situational and is tied to a work environment. There is a difference between situational or generalized condition.

Long Term Claims and a Toxic Work Environment
I was off on LTD for a neurological disorder. After working with my neurologist and getting new medication my condition improved somewhat. I did return to work with my doctor’s blessing but now the medication appears to not be as effective and I need to stop working. I gave my adjuster a letter from my neurologist saying I need to be off work but the adjuster refused to put me back on LTD. Should I appeal?
Appeals are internal processes for the insurance company to have a client repeatedly go back and forth, and no clear end in sight. It is always advisable not to appeal.
