- Chronic pain after an accident: After a car accident, some individuals, despite treatment, still experience ongoing injuries and chronic pain. Serious injuries can lead to both physical as well as psychological conditions and symptoms. It is important for those who are unable to work due to ongoing health conditions, to apply for long-term disability.
- Responsibility in a car accident: It is vital for those involved in a car accident to ensure details of the accident are documented and reported to their insurnace company accurately. Individuals who feel their concerns are not being addressed by their insurers should speak to a personal injury lawyer. All injuries, physical and psychological, must be treated. Individuals would be entitled to more compensation if they decide to follow through with treatment.
- Pain and suffering compensation: It is important for anyone injured in a car accident to continue to follow medical advice and recommended treatment. Insurance companies often operate under the assumption that if there are no medical records, a claimant is not entitled to certain benefits. Claimants are still entitled to pain and suffering compensation despite a minor injury.
- Two-year mark on LTD: After the first two years on long-term disability, the test in order to qualify for disability benefits changes. After the initial two years on long-term disability claimants have to prove they are disabled from working in any occupation. Claimants should only return to work if their own treating doctors have cleared them to do so.
- Traumatic brain injury after a car accident: In the event of a serious injury, such as a major brain injury, Section B benefits are available for the injured individual. Section B benefits are made available without delay in order to ensure the individual is able to seek treatment immediately. Other options are available to ensure treatment continues in the event that Section B benefits run out.
