Psychologist’s perspective on LTD claims

There has been a spike in mental health issues post-COVID-19 that prevent patients from working. As a psychologist, how do I ensure my patients receive approval for LTD?

  • Treating doctors reports: Many medical professionals and treating doctors are unaware of the specific terminology within long-term disability policies. Often the phrase “totally disabled” can confuse treating professionals. Doctors unsure how to best support their patients applying for disability benefits should speak to a disability lawyer. Doctor’s reports should be detailed and specify why a claimant is unable to work due to ongoing symptoms.

Appealing a depression disability claim

My brother has been suffering from depression for years. His psychiatrist recommended he apply for LTD, but his claim was denied. Should he appeal?

  • Depression and long-term disability claim: Mental health claims can be difficult for claimants to receive approval for. Insurance companies often justify a denial of a mental health claim due to a lack of objective medical evidence.
  • Appealing an LTD denial: The appeals process was created by insurance companies and is often unsuccessful. Appeals are not conducted by an objective third party and typically waste a claimant’s time. It is far more beneficial for claimants to file a legal claim.

3 Ways applying for CPPD can help your LTD claim

  • Test to qualify for CPPD: In order to qualify for CPP Disability, claimants have to prove that their disability is serious and prolonged. Unlike LTD, CPPD is a government program. Claimants that receive approval for CPPD have made it much harder for insurers to deny their LTD claim. The test in order to qualify for long-term disability simply asks that claimants are unable to perform the essential tasks of their own occupation.
  • Another source of income: In the event of a cut-off from disability benefits, claimants that have received approval for CPPD will have another source of income. Financial security can alleviate stress for claimants and enable them to pursue a legal claim.
  • Reduced monthly payments: In the event of approval for CPPD, the insurance company will receive a credit. Many disability policies stipulate that an insurer is able to deduct a presumed credit regardless of whether or not a claimant has applied for CPPD.

The insurer recommended occupational therapist

I have been on LTD for two years due to severe arthritis and fatigue. The insurance company has suggested they would like to send me to an occupational therapist. If I refuse this request, will my benefits be cut off?

  • Medical clearance from a treating doctor: Insurance companies are able to request claimants attend assessments or seek out appropriate medical treatment. Claimants do not have to follow prescribed treatments from the insurer if this advice is contrary to their own medical team. Before agreeing to any treatment or return to work plan, claimants should ensure their own doctors review the entire program.
