What is a workplace human rights violation?
In Canada, a human rights violation occurs when someone is unfairly treated or discriminated against based on protected characteristics like race, gender, disability, religion, or sexual orientation. These violations can happen anywhere, including at work, and involve actions that create an unfair, exclusionary, or harmful environment for individuals.
Both federal and provincial human rights laws are in place to protect individuals from these violations, ensuring everyone is treated equally and with respect across all areas of public life.

What happens if my human rights are violated?
Employees who experience discrimination or any form of human rights violation should report it to their superiors or HR department. Employers are obligated to investigate and take appropriate measures to address the situation and protect the victim.
However, it may reach a point where your work environment becomes so intolerable due to discrimination, harassment, or other adverse conditions that you feel compelled to leave your job.
If you believe that resignation is your only option, talk to the employment lawyers at Samfiru Tumarkin LLP. We can determine if your employer’s conduct has effectively ended, or terminated, the working relationship, in which case you may be entitled to full severance pay – as much as 24 months’ pay – through a constructive dismissal claim.
