What is workplace harassment?
In Canada, workplace harassment refers to a pattern of unwelcome or offensive behaviour, actions, or communication directed towards an employee or group of employees in a work setting. This behaviour creates a hostile, intimidating, or uncomfortable work environment and can take various forms.
Workplace harassment is governed by federal and provincial laws and regulations, including human rights legislation and workplace health and safety laws, that may vary depending on the jurisdiction.

What happens if I experience harassment?
Employees who experience harassment should report it to their superiors or HR department, and employers are obligated to investigate and take appropriate action to prevent further harassment and protect the victim.
However, it may come to the point where your employment becomes so unbearable due to workplace harassment, discrimination or other unfavourable conditions that you feel forced to quit your job.
If you believe that resignation is your only option, talk to the employment lawyers at Samfiru Tumarkin LLP. We can determine if your employer’s conduct has effectively ended, or terminated, the working relationship, in which case you may be entitled to full severance pay – as much as 24 months’ pay – through a constructive dismissal claim.
