Wrongful dismissal for Manitoba man fired for vaccination status
A former employee in Manitoba is suing his previous employer as he was fired for refusing to prove he was vaccinated against COVID-19. After almost two decades of employment, the individual states he had always worked from home and vaccination was not part of his employment contract.
Lior Samfiru, an employment lawyer and national co-managing Partner at Samfiru Tumarkin commented on the suit with CBC News.
Samfiru states that his firm has represented many clients across Canada who have lost their jobs as a result of their vaccination status.
“I can tell you that that is one of the most common issues that employees have faced over the past six or seven months, which is dealing with their vaccination status and the impact of that status on their job,” said Samfiru.
Samfiru goes on to explain what a wrongful dismissal is and how it applies to the employee in question. “A wrongful dismissal means that you are let go without compensation. So if he had been paid proper severance, it would not be a wrongful dismissal.”
