Disability/Personal Injury

My disability claim was denied. What should I do?

Answer: Your disability claim may be denied by the insurance company for a number of reasons.

Your claim may be denied because your insurance company feels that you have insufficient medical documentation and that your disability is not supported by facts.

Your insurance company may tell you that you are not “totally disabled” and are well enough to do the essential parts of your job or any job you are suited to do.

Another reason for a disability claim denial is that your insurer has gathered surveillance of you that they believe proves that you are not disabled.

Insurance companies will also try to use their own medical doctors or consultants to argue that your disability claim is not legitimate.

Your claim may also be denied in the early stage because your insurance company believes that you did not fulfill the qualifying period (also known as a waiting period). During this period, you must be continuously disabled for a specific period of time.

If you don’t have a diagnosis for your medical issue, the insurance company will be unable to determine your restrictions. This may be an additional reason for denial.
