Alex Lucifero, an Ottawa employment lawyer and Managing Partner at Samfiru Tumarkin LLP spoke to CTV News’ Dylan Dyson on the subject and defines the concept of “time theft”.

“When an employer is paying an employee for the time they ought to be working. Time theft occurs when that employee is not working, not being productive, or doing personal tasks instead,” says Lucifero.

In order to pursue discipline and termination, Lucifero explains employers will have to prove time theft has occurred.  “It’s hard for an [Ontario] employer to prove cause for termination. However, I do believe time theft may be one of those situations if it’s significant.”
