Old Republic facing class-action lawsuit
A class-action lawsuit has been launched against insurance company Old Republic. Along with Arch Insurance, both companies have been negligent in offering families who purchased trip cancellation insurance through them the refunds they are owed after trips were canceled due to COVID-19.
Toronto disability lawyer, Sivan Tumarkin from Samfiru Tumarkin LLP represents the families and lead plaintiff high school teacher Mark Chmielowiec and joined Bill Kelly to discuss the ongoing lawsuit.
What They Discussed
- Is Old Republic the second insurance company facing a class-action lawsuit in regard to canceled trips? The school trips have been booked through the travel company Explorica who told families to book travel insurance through Old Republic as well as Arch Insurance. Both companies have refused to pay families.
- What does it mean when the insurance company says they do not have enough information to reimburse families? The insurance companies are alleging the trip company Explorica, has not passed on the proper information for the families involved.
- Is dealing with insurance companies becoming increasingly difficult? It is important to remember that when purchasing insurance, you are essentially buying peace of mind for situations like the circumstances these families are facing.
- Why is it important to have legal representation in situations like this? Many individuals are told inaccurate information by insurance companies despite being legally owed compensation.
