Employee rights as Indigo goes private: Alex Lucifero on CTV News

Alex-Lucifero

Interview Summary

Indigo has announced it is going private after shareholders held a vote. The privatization has led to questions regarding employee rights. Will this impact Indigo employees in a significant manner? How are employers obligated to deal with the privatization of a company?

Alex Lucifero, an Ontario employment lawyer and Partner at Samfiru Tumarkin LLP joined CTV News Ottawa to discuss the rights of employees and employer expectations.

Interview Notes

  • Current Indigo employee rights: Lucifero explained that whenever a transaction is conducted by a company, whether that be an acquisition, privatization, etc., there is always a degree of change and turnover. “It likely means that there will be some restructuring, and typically some employees will be losing their employment.”
  • Entitlements for those who are let go: Lucifero reiterated the importance of severance for terminated employees as well as the rights of those who are still employed. “For those employees, it is very important to know that your tenure doesn’t change. For those employees losing their job, they are owed severance like anyone else would be in this situation.” Severance would be based on an employee’s age, position and years of service.
