Arch insurance failed reimbursements lead to class action lawsuit
Canadian families across the country have decided to take action against Arch Insurance as they have not been properly compensated for cancelled trips due to the pandemic.
On behalf of the many families involved and lead plaintiff Carter Adnams, a class-action lawsuit was launched against Arch Insurance by Samfiru Tumarkin LLP. Sivan Tumarkin, a Toronto insurance lawyer spoke with the Toronto Sun on the ongoing suit.
“Arch and Explorica are pointing the finger of blame at each other, leaving countless families in financial limbo,” Tumarkin claims. “The fact is that Arch and other travel insurance providers must honour their contractual obligations under the travel policies they issued, and pay these legitimate travel insurance claims immediately.”
Tumarkin goes on to state that failing to reimburse families has brought unnecessary stress at an already difficult time; “by continuing to withhold payment owed to the Adnams family and others impacted by the cancellation of school trips, Arch has failed to deliver the peace of mind that their customers rely on when paying for their services,” he alleges.
The statement of claim was filed on Thursday October 15th, 2020. A class action was launched against Old Republic just days later.
