- Pedestrian struck by a car leads to an inability to work: Severe injuries can occur in accidents involving cars and pedestrians. Some individuals are unable to work for a long period of time after an accident due to sustained injuries. Due to the progressive nature of some injuries, such as brain and head injuries a prognosis can change. Injured individuals should consider applying for long-term disability if they have the support of their doctor. Section B benefits are available to those unable to work and in need of treatment and rehabilitation.
- Trusting an insurance adjuster: Insurance adjusters ultimately do not want to pay benefits. Adjusters are told to protect the interests of the insurance company. Due to this, claimants should not place their faith in their insurers. It is important for claimants to be aware of their rights and possible entitlements.
- Communicating with the insurance company: It is not advisable for claimants to negotiate with their insurers on their own. By hiring a disability or personal injury lawyer, claimants ensure they no longer have to communicate directly with their adjusters. Claimants should seek legal advice before signing a release offered by their insurers as it can prevent them from pursuing any future claims.
- Eligible benefits after an accident: Anyone injured in Alberta as the result of a collision with a motor vehicle is typically eligible for Section B benefits. Section B benefits will cover a portion of medical costs and rehabilitation. In addition to medical benefits, claimants can also be eligible for income loss if they are unable to work due to their injuries.
