- Rear-ended car accident: Individuals with serious injuries involving surgery and extensive treatment after a car accident at times need to access long-term disability benefits. While claims can be denied by disability insurers, claimants should seek the advice of a disability lawyer. Disability and personal injury claims can be multifaceted and involve multiple insurance companies.
- Compensation after a car accident: For those injured in the event of a car accident, benefits are available. Section B benefits are considered to be no-fault benefits and can include medical benefits, counselling services, physiotherapy, etc. Medical coverage is available for individuals for up to two years after the accident for up to $50,000.
- The at-fault driver benefits: For individuals that are injured due to the fault of another driver, compensation might be owed from the other driver’s insurance company. Serious impairments, such as brain or spinal injuries, would not be limited by the pain and suffering benefits cap.
- Limitation period after an accident occurs: Individuals have up to two years after a car accident occurs to pursue a claim for benefits. It is important for everyone involved in an accident to bear in mind the limitation period.
- Need for caregiving help due to an injury: Under Section B benefits, income replacement is also available for anyone unable to continue working due to an injury. Individuals are also able to pursue at-home care and aid. Personal injury claims can be complicated and it is important to seek adequate legal advice.
