- Contract worker returned to job from injury but let go: Individuals that have been made to sign multiple employment contracts after a period of time, are legally considered employees. After the third contract, regardless of an employer’s classification, the contracts are meaningless. Employees will be owed severance pay upon termination.
- Job rescinded by an employer: Employees should consider what they have lost if an employer rescinds a job offer. Future employers would have to pay a prospective employee severance pay if the employee lost other employment or incurred financial losses as a result.
- Employer placing an employee on a layoff: During the pandemic, many employers placed employees on a temporary layoff. Employees do not have to accept a temporary layoff and are within their rights to refuse. Employees that have been laid off should seek legal advice and determine if they are able to pursue severance pay.
- Full-time to part-time employment: Employers are not required to allow employees to switch from full-time to part-time work. Employees that have been granted their request should consider if they are being given a new employment agreement. Employment contracts could contain a termination clause that limits future severance entitlements. Employees are not required to retire by a certain age and cannot be forced to do so.
