  • David’s Bridal closures: David’s Bridal has declared creditors protection. Many businesses, like Nordstrom, have filed for bankruptcy. Filing for creditor protection typically means employees will not be able to pursue their severance entitlements. Employees would still be owed severance pay if a company shuts down but does not declare bankruptcy.
  • Clauses in employment contracts: Employment contracts typically contain language that can restrict the rights of an employee, such as the right to severance pay. Employees should be wary of signing a contract without first seeking legal advice from an employment lawyer.
  • Fired for cause due to misbehaviour: Employers are within their rights to terminate an employee for any reason, without cause. It is very difficult to terminate an employee for cause. In order to justify a termination for cause, employees will have to exhibit serious misconduct. Employers have to prove disciplinary action has been taken and there are no alternate options available.
