• Misclassified as a contractor by an employer: Many individuals are incorrectly classified as independent contractors by their employers. Ultimately, employment laws dictate the classification of an individual, not the employer. Employees that are misclassified are exempt from many rights they are entitled to, including severance pay upon termination.
• Taking medical or stress leave: Many employees returning from medical leave are not accommodated appropriately by their employers. Employees cannot be penalized for taking a medical leave of absence. Employers must accommodate an employee’s medical limitations at the workplace. Employees must be brought back to the same terms of employment they had prior to their leave.
• Employee fired for raising harassment complaints: Employers are obligated to investigate all complaints of bullying and harassment at the workplace. All employees are entitled to work in a safe and harassment-free work environment. Employees cannot be penalized or terminated as a result of filing a complaint.
