- Employee unable to work due to medical condition: Employees that are unable to work due to a medical illness and need to take sick leave should speak to a doctor. It is advisable to give an employer a doctor’s note stating an inability to work. Employers must request a note from an employee and cannot terminate an employee or penalize an employee without taking that first step.
- Taking a medical leave for employees: For employees that are unable to work for an extensive amount of time, a doctor’s note is required to provide to their employer. A note from a doctor does not have to detail the specifics of an employee’s medical condition but should include a prognosis and eventual return to work date. Employees can be away for medical leave for however long it takes to recover.
- Employer cuts off certain benefits while an employee is on long-term disability: Employees should continue to receive the benefits that they are entitled to while on long-term disability leave. Employers are able to stop certain benefits depending on the terms of an employee’s contract or benefits plan. Employees that are unsure of their rights should speak to an employment lawyer and first their employer regarding their concerns.
