- Mediations and information provided: Mediations are a vital element of the legal process when filing a disability claim. Important information can be provided to all parties involved that helps to ensure a claim is resolved. It is important to provide all relevant medical documentation and changes or updates to a retained disability lawyer. Some information can significantly impact a claim.
- Constant questions by insurance adjuster: While insurance adjusters are obligated to operate in good faith with claimants, they are also permitted to ask for updates from claimants. Some claimants could be improving and there are signs of a possible return to work, insurers will take a greater interest in their progress. Claimants experiencing significant stress as a result of communication with an adjuster should vocalize their concerns with their treating doctors.
- Funding recommended therapy: Claimants are expected to attend an independent medical examination if requested by an insurer. The assessor is expected to provide answers to the insurer, possibly regarding a prognosis. Based on the report, treatment recommendations can be made. Some rehabilitation or treatment plans are not accessible or advisable from a claimant’s own treating doctor.
- Parkinson’s diagnosis and disability benefits: A diagnosis itself does not entitle claimants to disability benefits. In some cases, a medical condition can progress in severity with time. Many individuals are able to work at some point, but as symptoms progress, are no longer able to do so. It is not advisable for claimants to change their employment status before applying for long-term disability benefits. A change in employment status from full-time to part-time will result in a change in benefits.
