- Specialist deems individual unable to work: Insurance adjusters often rely on the reports of an independent medical examination in order to justify an end to disability benefits. On occasion, specialists can confirm to the insurer that a claimant is unable to work due to ongoing symptoms. Claimants continuing to undergo treatment and are yet unable to return to work, should speak to a disability lawyer.
- Income while on long-term disability benefits: Most disability policies contain terminology that outlines what other benefits and income claimants are able to receive while also receiving benefits. Passive income is generally permissible under most disability policies. Claimants who are unsure about their entitlements should look closely at their disability policies.
- Insurers requesting more medical information: It is important for claimants to provide updated medical records and reports to their insurance adjusters. Long-term disability benefits are monthly benefits. Adjusters have to justify releasing benefits every month and so consistently try to find reasons to end benefits. Claimants are within their rights to speak to their treating doctors if communication with their adjusters is causing additional stress and harm.
- Severance and disability benefits: Employment and disability issues can often overlap. Employees on disability leave for a long period of time can experience “a frustration of contract“. Employers are able to trigger this provision and would owe their employees their minimum severance entitlements. It is important to speak to a disability lawyer aware of the multifaceted nature of a claim. Severance pay can affect the amount of disability benefits an individual receives.
