  • Significant injury due to a slip and fall: After a slip and fall accident occurs, the individual involved should ensure all details of the incident are recorded and documented. Many individuals that have broken limbs or had extensive treatment and surgery have ailments in the future. It is important to file an appropriate personal injury claim and ensure all parties responsible are accounted for.
  • Sent for a functional capacity evaluation: Individuals on long-term disability are often sent for a skills assessment by their insurer as they approach the two-year mark on long-term disability. After two years on long-term disability, claimants enter the “any occupation” period. In this period individuals will have to prove they are disabled from working in any occupation and not simply their own.
  • A pedestrian hit by a car leads to serious injury: Pedestrians are able to pursue compensation if they are injured in a car accident. In Ontario, the driver responsible for the collision is presumed to be at fault. Pedestrians would be entitled to accident benefits from the driver’s insurance company such as income replacement benefits, rehabilitation expenses, etc.
