You must be able to prove that the occupier of the premises (i.e. the person who had care and control of the area where you fell) failed to act reasonably to ensure that the area of the fall was properly maintained. The legislation that governs such claims in Ontario is the Occupiers’ Liability Act.

Injuries on Municipal Grounds

If you fall on municipal grounds, you must notify the municipality of your intention to start a claim within 10 days of the accident by written notice to the clerk of the municipality. See section 44(10) of the Municipal Act.
