- Disconnect between reports to insurer and surveillance: In most cases, claimants do not have to worry about surveillance conducted by the insurance company while on long-term disability. Claimants should be open and honest with their insurers and follow recommended medical treatment. Individuals who are unsure about their rights in the event that there is a disconnect between surveillance and the medical information provided should seek advice from a disability lawyer.
- Forced treatment by the insurance company: It is important for claimants to look closely at the terms outlined in their disability policy. Some disability policies can require claimants to participate in certain treatments. Claimants should ultimately follow the advice of their treating medical team.
- Finding a new job after a change of definition occurs: At the two-year mark, a change of definition occurs in which claimants have to prove that they are disabled from working in any occupation, as opposed to their own occupation. Often, at the two-year mark claimants will experience their benefits being cut off. An analysis is typically conducted by the insurance company to determine what a claimant might be suited for in terms of other jobs.
- Transitioning from short to long-term disability: It is not automatic for claimants to receive approval for long-term disability after being on short-term disability. Many insurers will resist approval for LTD after short-term disability. Most employers have different insurers for their short and long-term disability benefits. There are certain time frames in which claimants have to apply for disability benefits.
