- After a decade of LTD, a claimant returned to work part-time: It is important for claimants to be honest and keep open communication with their insurance adjusters if their arrangement has changed. Claimants that have returned to work with the approval of their doctor, but with restrictions, and must continue to receive benefits should note that their payments will be reduced.
- Claimants exhibit shock and panic when denied LTD: Claimants that are disabled from working and have the support of their doctor should technically qualify for LTD but in many cases are denied. Denial can lead to panic and extreme psychological and emotional distress. Individuals should contact and seek out a disability lawyer as soon as possible in order to determine the next steps.
- Ineffective appeals process after an LTD denial: Claimants appealing a long-term disability denial are asking the same adjusters and individuals to look through their claims. Appeals are not sent to an objective third-party arbitrator and generally waste time.
- Employment insurance sickness benefits and LTD benefits: Claimants should not be cut off if there happens to be an overlap between EI benefits and LTD benefits. It is important for claimants to be open and honest about their income. All communications between an insurance adjuster and a claimant should be documented in writing.
