Show Notes
- Home insurance and claims after a natural disaster: It is important for individuals to ensure what is included in their policies in order to protect themselves in the event of a storm. Ultimately, it is important to understand the provisions and language used in property coverage.
- Disabling headaches and migraines preventing individuals from working: Many claimants initially are approved for short-term disability coverage and recover to an extent where they believe they can attempt a return to work, which is not always successful. Ongoing health issues can prevent individuals from working in more than one job. Employers should also be wary of terminating employees as a result of a medical condition. In some cases, claimants are still able to access a recurrent clause from their policy even if they no longer work for their original employer.

- Disability coverage policies set up with employer: It is important for employees who are compensated in various ways, not just a base salary, to determine how their coverage is calculated. Disability coverage is typically set up through an employer’s group plan and often does not cover other elements of compensation which can lead to a lower rate of benefits.
- Communicating with an insurance adjuster: Once a legal claim has been filed, clients have as little communication as possible with the insurance adjuster as a disability lawyer alleviates the burden of the ongoing process. Claimants are able to focus on their own recovery and health. Typically after months after a disability lawyer has been retained, mediation takes place. Claims rarely lead to court.
- Insurance adjuster reevaluates claim after a few months: Often insurance adjusters generalize medical conditions in order to stay away from the specifics of a claimant’s actual health and ongoing symptoms. Adjusters are obligated to provide an explanation if benefits are cut off.
