Show Notes
- Jury trials and decisions regarding legal long-term disability claim: A recent jury decision awarded a claimant over $1 million in punitive damages. It is very rare for punitive damages to be awarded at such a high scale. There was a lot of criticism regarding the litigation and the amount of surveillance conducted by the insurance company.
- Denying claims to those with long-COVID-19: It is important to remember that most long-term disability policies are concerned with the symptoms an individual exhibits that prevent them from working and not the diagnosis itself.
- Skills analysis while on long-term disability: Insurance companies typically ask claimants for information regarding their skills and whether or not a skillset is transferable to another job. This request occurs often at the two-year mark when there is a change in definition of disability.
