- Working remotely and returning to the office while on disability: Many insurance companies are taking the position that man claimants that have the option to work from home, should be able to do so despite their disability and are no longer entitled to LTD. Generally, the disability insurer should be putting into place the necessary accommodations with a claimant’s employer. It is important for claimants on LTD to speak to their treating doctors about possible accommodations required and how gradual the return to work plan should be.
- Insurance adjuster reviewing case if CPPD is approved: Long-term disability insurance is separate from CPP Disability benefits. CPP Disability benefits is a government-supported program. In order to qualify for CPPD, the test is much more difficult as claimants have to be able to prove a severe and prolonged disability. It is important that claimants do apply for CPP Disability despite approval for LTD as most disability policies expect claimants to apply.
- Harassment at work leads to disability and Workers Compensation: Insurance companies often deny LTD claims and inform claimants that they are able to appeal the denial. Appeals are rarely successful and are often implemented by insurance adjusters in order to waste a claimant’s time. Despite the approval of Workers Compensation, claimants are within their rights to apply for LTD.
